Who bought a T M Lewin shirt? I remember buying them a couple of times when I lived in London, and when the company went big online I was bombarded with those 4 shirts for £25 adverts!

It looked as though they were on a roll, but in June 2020, without notice T M Lewin dismissed all 600 employees as redundant and promptly went into administration. Nothing unusual in that you might say, but when a company is proposing to make 20 or more employees at one establishment redundant within 90 days, they must consult with those employee’s representatives (usually the union or elected representatives)1.

A failure to consult will give the employees a right to claim a ‘protective award’ which can be up to 90 days pay.

A multiple claim for a protective award by 4 ex employees was filed at the employment tribunal. The Judge held that the only issue before him was whether 20 or more employees had been dismissed at one establishment.
