  • Dismissed just short of two years’ service. What are my options?

  • Contracted for four days a week. Can employer use a bank holiday as one of the four days?

Dismissed just short of two years’ service. What are my options?

Q. I have had ongoing issues with a manager at my work, from sexual harassment/bullying and harassment/hate crime against me I have reported all of the above issues to my employer. I was then suspended from work as I overheard the same manager talking to another member of staff about me saying inappropriate things. I was placed on gardening leave for 2 months to try and resolve the issues an investigation meeting took place which no disciplinary action has been taken against me. I am two weeks short of my 2 years working for the company, I have now received a email saying my employment will now be terminated and haven’t been given the right to appeal this just wondering if you could give some advice on situation.

A. I presume your employment is being terminated without notice; otherwise, your length of service will take you up to two years or thereabouts. Check your contract to see if your employer is entitled to pay you in lieu of notice because it will affect your termination date. As you are probably aware you cannot claim ‘ordinary unfair dismissal unless you have that two year’s service.
