I recently read the employment tribunal backlog has hit 475K as of Dec 2022. If you’re contemplating a claim perhaps it’s time to master those negotiation skills and grab a favourable settlement ASAP!

Here’s today’s Q&As . . .

  • Payment for travel time in a new job. Am I entitled to it?

Payment for travel time in a new job. Am I entitled?

Q. I'm just starting a new job they are giving me a van and fuel card I'm going from home to different locations multiple times a day up 6 hours  driving should I be getting payed for this I'm on a 30 hour a week contract

A. If you are required to travel for work as part of your job, you are generally entitled to be paid for this time, as well as any expenses incurred such as fuel costs. This is true even if you are provided with a company vehicle.

However, the specific details of your employment contract will determine whether you are entitled to be paid for travel time and expenses. It is possible that your contract may specify that you are not entitled to payment for travel time or expenses, in which case you may need to negotiate with your employer with a view to being paid for it.

But, it is worth noting that the law requires that employees be paid at least the National Minimum Wage (NMW) for all hours worked. So, if your travel time takes you below the NMW for your total hours worked, your employer must increase your pay to ensure that you receive at least the NMW.


Overpayment of wages and bonus on leaving. Can employer recover the overpayment?

Q. A previous employer has overpaid me for a month's wage. They paid me for a full months wage, although I was off sick for 3 weeks. Included in this pay was a company  bonus, which they are also trying to make me pay back? Is this right?
