Q. I work for a car sales company who pay £18,000 basic pay, but deduct £400 per month from commission. Is this legal?
A. An employer can only make a deduction from your pay in these circumstances if you have previously agreed in writing to the deduction. So, you need to check your contract. It may say that there is a deduction each month from your commission or you simply don’t receive the first £400 of commission earned.
If there is no such term in your contract it is probably an unlawful deduction from your pay.
Holiday calculation
Q. I am paid on salary monthly with a contract of 2080 per year with an average of 40 hours per week. Any hours worked over this 2080 ie overtime is paid at any hourly rate but only once and at the end if the financial year. The payment time is in my contract and I am fine with the one of payment arrangement. However I am likely to work about 150 hours annually but still only recive my holiday pay on my average 40 hours per week. My salary pay includes day or night working, weekends and bank holidays. Holidays are generous at 35 days (7 weeks) but we are told the 52 week average does not apply. Do you think this correct.
