Prevented from taking holiday due to sickness. Can it be carried over?
Q. What happens to last years holiday entitlement if I’ve been off sick. I had heart attack last October and I just can’t get back so what happens to the weeks holiday I had left plus last Christmas holidays. I’ve got to make a decision soon as if I can go back so if I decide that I can’t go back am I still entitled to any holiday for this year

A. The law states that holiday should be taken in the year it is accrued unless your employer allows you to carry over unused holiday into the following leave year.
However there are circumstances when you can carry over holiday if you are prevented from taking it in the current leave year. Long term sickness absence is one of those, so if you couldn’t take your holiday because you were recovering from the heart attack it should be carried over.

Q. I have a question I'm hoping you can answer. I am currently suspended from my public sector job and have been for nearly a year. My question is, can I apply for any job be it public sector or private whilst I'm suspended? I have been told that this not allowed. I am confused.
